Terms of Service
By accessing or using Marketly (“Marketly,” “we,” “us,” or “our”), you agree to these Terms of Service. If you do not agree, please do not use the platform.
1. About Marketly
Marketly is an online marketplace that allows independent sellers (“Merchants”) to operate storefronts and offer products to customers.
Unless explicitly stated otherwise, Marketly is not the seller, manufacturer, or supplier of products listed by Merchants. Each Merchant is independently responsible for their products, listings, pricing, availability, fulfillment, customer service, and legal compliance.
2. Acceptable Use
You may use Marketly only for lawful purposes. You may not:
* Violate applicable laws or regulations.
* List products prohibited by Marketly.
* Engage in fraud, scams, deceptive practices, spam, or harmful activity.
* Misrepresent yourself, your business, or your products.
* Interfere with or attempt to bypass Marketly’s security, payment, or marketplace systems.
Marketly may remove listings or restrict, suspend, or terminate accounts that violate these Terms or present a risk to the platform or its users.
3. Merchant Responsibilities
Merchants are responsible for ensuring that their products and business activities comply with all applicable laws, regulations, licensing requirements, age restrictions, and advertising rules.
Merchants must provide accurate listing information, maintain accurate pricing and inventory, fulfill orders appropriately, handle applicable refunds, returns, and customer disputes, and respect the intellectual property rights of others.
Marketly does not guarantee that any Merchant, product, listing, or transaction complies with applicable law.
4. Products and Listings
Marketly may prohibit, restrict, or remove any product, listing, category, or Merchant when necessary to enforce platform rules, comply with legal requirements, or protect Marketly and its users.
Product descriptions, images, prices, claims, and other listing information are generally provided by Merchants. Marketly does not guarantee the accuracy, quality, legality, safety, availability, or suitability of Merchant products.
5. Purchases, Payments and Refunds
Customers purchase products from the applicable Merchant unless Marketly expressly states otherwise.
Refunds, returns, cancellations, fulfillment issues, and other order-related matters are generally the responsibility of the Merchant.
Where cryptocurrency is used, users acknowledge that transactions may be irreversible and may be affected by blockchain confirmation times, network fees, or other circumstances outside Marketly’s control.
6. Intellectual Property
Marketly’s platform, software, branding, logos, design, and original content are owned by or licensed to Marketly and may not be copied or distributed without authorization.
Merchants retain ownership of content they submit but grant Marketly permission to display and use that content as reasonably necessary to operate and promote the marketplace and their storefronts.
7. Third-Party Services
Marketly may use third-party providers for hosting, payments, security, analytics, and other services. Marketly is not responsible for circumstances caused by third-party services outside its reasonable control.
8. Disclaimer and Limitation of Liability
Marketly is provided on an “as is” and “as available” basis. To the extent permitted by law, Marketly makes no guarantee that the platform will always be available, uninterrupted, secure, or error-free.
To the maximum extent permitted by applicable law, Marketly and its owners, operators, employees, and service providers are not liable for indirect, incidental, special, or consequential losses arising from use of the platform, Merchant products or conduct, failed transactions, cryptocurrency networks, or third-party services.
9. Indemnification
To the extent permitted by law, Merchants agree to indemnify and hold harmless Marketly and its owners, operators, employees, and service providers from claims, liabilities, damages, costs, or expenses arising from their products, listings, transactions, violation of these Terms or applicable law, or infringement of third-party rights.
10. Suspension and Termination
Marketly may restrict, suspend, or terminate accounts, listings, or access to the platform when we reasonably believe these Terms have been violated, applicable law requires it, or activity presents a risk to Marketly or its users.
11. Changes to These Terms
Marketly may update these Terms from time to time. Updated Terms will be posted on the platform. Continued use of Marketly after an update constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws applicable in the jurisdiction in which Marketly operates, subject to any mandatory consumer protection or other applicable laws.
13. Contact
Questions regarding these Terms may be submitted through the contact information provided on the Marketly website.
